English Abstract:

Legal language is perceived as a part of natural language, although there are some differences concerning syntactic structure and semantics that may classify it as a sui generis language, which is a language in between the artificial and natural one, and similar to technical language (cf. Maciejewski, 2007: 133). Though the syntax of legal language and natural language is identical, there are some distinctive grammatical peculiarities (e.g. specific usage of present tense) and different stylistics rules (e.g. acceptable usage of repetitive words in a given sentence) (Stawecki, Winczorek, 2003: 56). Disparities are also seen in the usage of phrases characteristic only to legal language, not presented in natural language, e.g. adhesion process. At the same time, from the legal point of view, certain phrases often have a more detailed meaning(Petzel, 2006/XLV: 157). Creation of legal definitions that determine a certain way of understanding specific phrases used in a legal text, is one of the typical legal language traits (Wronkowska, Ziembiński, 1997: 149). Thus, avoiding the problem of vagueness and ambiguity, the legislator pursues the pragmatic goal of communication, that is achieving precision of records. This, among other things, causes that legal language cannot be perceived as a language of strictly defined rules of linguistics. Principally, it has to be considered that its specificity is created by the social situation in which this language is formed and by the demands that lay before it (See Maciejewski, 2007: 133). This issue can be clearly seen on the example of legal hunting language, whose present shape was particularly determined by the situational context in which its evolution took place. Its typical traits comprise of phrases frequently used in legal acts, usual also elements of hunting dialect. (Translated by Kiszka, Olczyk, Wojda)
