English Abstract:

Hunting (also ÔÇśgame shooting) is subject to strict legal regulations. Apart from the legislation, it is the hunting ethic that plays the fundamental role in hunting. In opposition to regular hunting based on legal and ethical principles, poaching is an element of illegal and unethical impingement on nature. Poaching, strengthened over centuries, has survived until modern times to find its reflection in contemporary harmful actions of the humans. The problem of poaching stems from the field of environmental protection and game shooting, also including hunting ethic and legislation. Traditions of many generations have conduced to poaching. The activity, known especially in the rural environment, is characterized by particular solidarity and conspiracy of silence. Despite recent law tightening, poaching occurs and escalates on a large scale. It is carried out with the help of various methods and tools. Modern poaching techniques are highly developed and have been constantly improved. Poaching occurs with various intensity and in some regions may pose major danger to game animals. It denies the fundamental rules of nature preservation and is contradictory to law and hunting ethic. Poaching as an activity against nature indicates lack of humanitarianism and decline in the sense of humanity. Drastic methods and poaching appliances usually cause death in lengthy torments. The data on poaching is incomplete and the numbers are most frequently understated. Poaching concerns hunting circles as well as communities that are not related to hunting. The former of whom should not stay indifferent in the face of poaching which has not been firmly denounced by the society. Hunters have a statutory duty to combat it also in their own company. They have their own disciplinary authorities as any other organization and are liable before the hunting and common courts for any violation of law, including poaching. Nowadays, there are better ways of limiting poaching. In the face of law, poaching business is legally condemned and counteracted. However, the possibilities of execution of the law are insufficient (low detection rate, difficulty in proving the offense, low interest of the police and the public prosecutor), small number of the convicted and relatively low penalties. One of the most significant effects of the actions taken by the Hunting Guard is the improvement in discipline among hunters in relation to hunting law.
